Before I proceed, I acknowledge that I have read and understood the Frequently Asked Questions and agreed to the Terms and Conditions of Sale.

This website can be accessed at www.cinemabox.co.za or www.cinemaboxshop.co.za, related mobi-sites and software applications (the “Website”) and is owned and operated by  (“CINEMABOX”, “Cinema Box”, “lessor”, “we”, “us” and “our”).
These Website Terms and Conditions (“Terms and Conditions”) govern the ordering, sale, use of device and delivery of Goods, and the use of the Website.
These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your”, “customer”, “lesee” or “user”), including without limitation each user who purchases as contemplated below (“also referred to as registered user”). By using the Website and Proceeding to Checkout by clicking on the “Checkout” and “Place Order” button on the Website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

1. The Website enables you to shop online for an extensive range of goods including electronics and more (“Goods”)
2. You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the device.

3. The lease/purchase of any device on the Cinema Box website is for the device only.

4. We are not responsible for the software or any apps installed and its usage against their terms and conditions. cinemabox.co.za, is not owned by, is not licensed by nor is a subsidiary of any of the apps. 

5. You acknowledge that Cinema Box is only responsible for the hardware sold and not any/all software. In addition, you agree that you will not in any way use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the device or information contained therein, without the prior written consent from CINEMABOX .

6. You may not use the Website and Promotional Content to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful. You may not in any way display, publish, copy, print, post or otherwise use the Website and/or the information contained therein without the express prior written consent of CINEMABOX.

7. The Cinema Box does not contain the storage, distribution and usage of illegal or pirate content. Cinema Box is a device which uses an Android operating system. No KODI playlists are preinstalled on the device. A minimum 4MB Internet line speed connection is required for operation.

8. CINEMABOX is completely dependent on a stable internet connection. Cinema Box is not liable or responsible for a poor connection at any time. If there is any blocks or throttling on your connection from your ISP, please resolve it with them directly as we are not responsible for this. A VPN maybe required to bypass and restrictions on your internet connection which is your own responsibility. Cinema Box are responsible for the device only according to the Terms and Conditions and NOT the APK’s loaded onto the device, its maintenance and its use.

9.1 Cinema Box has no control whatsoever nor may it be held liable for the content or location of the streams, which shall be the sole responsibility of the pages on which they are hosted.

9.2 Furthermore, Cinema Box may not be held liable for any failures in the display of content, internet connections, viruses, etc. that may pose a threat to your device.

9.3 Cinema Box provides users with a non-exclusive license of use free of charge for its applications for a limited time only and is unable to guarantee continuity.

9.4 By using our services, you may access contents that do not belong to Cinema Box. Any such content is the exclusive responsibility of the party that makes it available to users. Cinema Box may therefore not guarantee that such content is not in breach of third party rights.

9.5. Cinema Box cannot guarantee the quality of links and streams. Incorrect labelling on links may occur.

10. As a consequence, Cinema Box may not be held responsible for the content or the potential breach of third-party rights.

10.1 The use of our services does not grant any rights of ownership over their intellectual property or that of the content accessed.

10.2 These terms and conditions do not grant the right to use trademarks or logos that appear on our service, whether held by Cinema Box or third parties.

10.3 As a search tool, the Cinema app dynamically indexes the contents of streams used on the web at any given time. The indexed contents may only be controlled at source by the party that uploads them onto the web.

10.4 Should the holder of a copyright consider that her/his right have been breached, she/he must address the source to request its withdrawal.

RETURNS/CANCELLATIONS/REFUND POLICY

11. We expect items returned to us to be in good condition,

12. complete with packaging and all components including any free gifts if applicable, within 7 days. 

13.1 In particular this means that you will:

13.2 Return all products delivered i.e the CinemaBox device, power cable, HDMI Cable, all Remotes and original packaging with inserts.

13.3 Return in good condition all packaging, manuals, cables etc
13.4 Return the goods in a condition that would enable us to repurpose them.
13.5 NO refund on the return courier/shipping/postage costs.

13.6 No Cancellation or Refunds on Sale or Promotional Items. We will allow for an Exchange (if the item is defective) or Store Credit. If an item has been purchased it cannot be cancelled and replaced/substituted for a sale/promo item then on offer.

13.7 The return of goods is for the cost of the customer (delivery cost to CINEMABOX). 

13.8 If you fail to take delivery of your order, we will make one more attempt to deliver to you at our cost, there after the item will be returned to us where we will store for 30 days. If the item remains unclaimed we will provide you with store credit and the item will be returned to our inventory.

14. Return and Refund FAQs:

14.1 Can I cancel my order prior to delivery?

No, you cannot. Orders may not be cancelled after receipt of payment and/or dispatch of your Goods, you may cancel the Sale only in accordance with the Returns Policy.

14.2 What happens if the item I have bought arrives damaged?

If your parcel arrives damaged, and the seal is broken, please check the contents before accepting it from the courier, and make a note of the damage on the waybill . If you do receive a damaged item, please let us know ASAP and book your return within 2 working days of delivery. You must return the product to us in the condition you received it. Please bear in mind that in some cases we may need to have your item assessed by the supplier, authorised dealer or repair agent.

14.3 What happens if the item I have bought doesn’t work properly?

Depending on how soon you encounter the manufacturing defect, your returns will be assessed according to our returns policy. Please keep in mind that in some cases we may need to have your item assessed by an authorised dealer or repair agent. For this reason you are not allowed to tamper with the software setup or attempt any factory resets. If any damage or malfunction is caused by the user this will be taken in account and will affect our decision. If your item is found to be defective purely due to a manufacturing fault, within 6 months of delivery, we will replace that item.

14.4 What happens if an item I thought was defective actually works?

If your item was returned as defective, but it’s actually in perfect working order, then we will return the item to you. You will be liable for the costs of collecting and returning of the item. Please note that if these costs are not paid within 3 months of being notified, the product will be sold to defray storage costs.

14.5 What happens if I didn’t get what I ordered?

If we didn’t send you what you had ordered, please let us know as soon as possible so that we can resolve the mix-up.

14.6 Can I return sale/promotion products?

No, All items/products purchased from any of our Sales and/or Promotions are “FINAL SALE” products and cannot be returned, no exceptions.

14.7 How long will you take to process my refund?

We try to process all refunds as swiftly as possible.

14.8. How to use the Device/Technician Service?

Simply go to the nearest Aramex Dropbox, usually found at a PicknPay or Checkers Hyper and purchase your Aramex bag. All you have to do then is put in the entire contents of your purchase according to the terms and conditions of sale, seal the bag and take a picture of the DBP waybill number before you drop it in the bin. 

Please fill in the form found online at http://0zm.dd9.myftpupload.com/repair-form/ and send us the DBP number immediately via WhatsApp so that we can assign the package digitally using the DBP number you provided . 

Drop your parcel in the red Aramex Drop Box in-store before 3pm Monday to Friday and your parcel will be delivered to the nearest CINEMBOX Technician within 72 hours, depending on the destination*.

Important: Our Device Service Fee is free but you are responsible for the courier costs to and from our technicians. We will contact you once your device is ready to be shipped back to you. Please ensure to deposit R99 to CINEMABOX, Standard Bank, Cheque Acc no:10153511107 – Use Order Number as reference, we will ship to the address on record.

15. Delivery of goods

15.1 Cinema Box offers delivery via door-to-door courier 
15.2 Our delivery charges are subject to change at any time, without prior notice to you. You will see the applicable delivery charges in your cart when you check out.
15.3 Where it accepts your order, Cinema Box will deliver the Goods to you as soon as reasonably possible, but no later than 60 working days of receipt of your payment (“Delivery Period”).

15.4 We will notify you if we are unable to deliver the Goods during the Delivery Period.
Cinema Box’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order.

15.5 If a staff member or family member at the delivery address signs CINEMABOX’s delivery note, such signature shall be as if the Customer had signed

15.6 Cinema Box is not responsible for any loss or unauthorised use of a product, after it has delivered the product to the physical address nominated by you.
15.7 When you place an order on this site you will be asked for a physical address as well as the street postcode.

15.7 What does delivery cost?

A flat fee of R99 delivery cost per CINEMABOX currently applies to each order delivery. This cost may change at any time.

15.8 How important is the Suburb and Postal Code?
The accuracy of your delivery will depend on the Suburb and Postal Code in the address you provide. Simply enter all the requested details. If you are unsure, please email admin@cinemaboxshop.co.za

15.9 How do I return the Cinemabox?

The return of the device must be completed via courier. The device must be returned in its original box, with all its original components. The devices must be returned in its original box within a flyer bag to secure its state during courier.

15.10 When will my order ship?
Orders normally ship within 7 to 10 days after receipt of payment. PLEASE NOTE that the shipping time is not the delivery time (shipping time is the time for an item to be dispatched from our warehouse). Festive Season Times Apply During Peak Season.

15.11 When do I get my order?

Main Centre* Delivery: Courier: 7-10 Working Days after receipt of payment.
Gauteng Area* Delivery: Courier: 7-10 Working Days after receipt of payment.
Regional/Remote Area: 7-14 Working Days after receipt of payment.
Courier – Home/Office delivery via courier between 8am – 5pm, Monday to Friday

These delivery times are estimates and we cannot guarantee exact delivery times. Please note that although our couriers will make every effort to deliver to you promptly, adverse weather conditions and other factors may cause unavoidable delays.

Please contact us should you require further information on delivery in your area.

15.12 Does Cinema Box ship internationally?
No, we do not unfortunately ship outside of South African borders currently.

15.13 Will I have to sign for my package?
No, you do not need to sign. Please advise us when you order, should someone else will be signing on your behalf.

15.4 What happens if an item is missing from my shipment?
Contact us within 24 hours of the delivery having taken place. Please have your Order Number ready.

* Please note:

The countdown in terms of the shipping period begins once your payment has been authorised. For credit cards this means that once the bank gives us an authorisation code. For cash deposits and Internet transfers this means once the funds reflect in our bank account. We do not accept cheque deposits, but should you deposit a cheque, clearance will only be 14 days after the deposit.
Working days are defined as Mondays to Fridays, excluding Public Holidays.

16. Personal Information

16.1 The customer acknowledges that CINEMABOX will store, process and use the customer’s personal information in order for CINEMABOX to comply with the terms of this Agreement. Such information includes, but is not limited to the customer’s addresses and contact details, identity number, banking details, employment and financial information, demographic information and credit history.

16.2 The customer further agrees to CINEMABOX storing, processing and using the customer’s personal information for, inter alia, the following purposes:

16.3 Marketing CINEMABOX and CINEMABOX affiliates’ current and future products to the customer from time to time;

16.4 Analysing customer data and trends from time to time itself and with the assistance of service providers;

16.5 Reporting information on the customer and the manner in which the customer conducts its account to credit bureaux and other similar organisations from time to time

 

17. Product Specific Terms and Conditions

Electrical Equipment

17.1 Equipment purchased requiring electricity will be connected to the customer’s electricity supply during installation & should not be interfered with as this may cause death or serious injury to anyone in contact with the equipment at the time or later if the interference results in an electrical fire. Where the connection to the electricity supply requires more than ‘plugging the appliance in’ any electrical work or certificate of compliance must first be done by the customer at the customer’s cost.

17.2 The customer shall be obliged to use any and all equipment and accessories strictly in accordance with the specifications, instructions and directions laid out by the manufacturer of such equipment.

DISCLAIMER-CINEMABOX CAN PROVIDES SUPPORT FOR THE SOFTWARE THAT COMES PRE-LOADED THE PRODUCT THAT YOU PURCHASE FROM US. ANY MODIFICATIONS, ADDED PROGRAMS, ADDED ROM’S OR DELETED PROGRAMS ARE THE RESPONSIBILITY OF THE SOFTWARE CREATOR AND THE END USER. WE WILL NOT PROVIDE SUPPORT FOR ANY EXTERNAL MODIFICATIONS YOU HAVE DONE TO THE PRODUCT YOU PURCHASE FROM US.

WE PROVIDE SUPPORT FOR THE ORIGINAL PRE-PROGRAMMED APPLICATIONS THAT COME WITH THE BOX. WE GUARANTEE THAT THE APPLICATIONS WE PRE-LOAD ON THE BOX IN THEIR ORIGINAL STATE WORK, PLAY VIDEO AND PLAY SOUND. WE DO NOT UNDER ANY CONDITION SUPPORT ADDITIONAL PROGRAMS SUCH AS XBMC/KODI INSTALLATION WIZARDS (XBMC HUB WIZARD, XUNITY TALK OR WIZARD, SUPER REPO INSTALLER AND ANY OTHER XBMC INSTALLATION PROGRAMS), ADDITIONAL ADD-ONS, EXTERNAL HARD DRIVES, PRIVATE NETWORKING SET-UPS OR PROGRAMS, EXTERNAL USE OR BLUETOOTH DEVICES, REMOTE CONTROL APPLICATIONS OR GOOGLE PLAY APPLICATIONS.

CINEMABOX DOES NOT HOST, SUPPORT, OWN OR HAVE ANY AFFILIATION OR CONNECTION WITH ANY PROGRAMS OR ADD-ONS THAT COME PRE-LOADED ON THE DEVICES. CINEMABOX DOES NOT HOST, SUPPORT, OWN OR HAVE ANY AFFILIATION WITH ANY OF THE STREAM SOURCES, SERVER OR CONTENT PROVIDERS WITHIN ANY OF THE PROGRAMS THAT COME PRE-LOADED ON ANY OF OUR PRODUCTS. WE DO NOT GUARANTEE THE CONSISTENCY, BANDWIDTH, VIDEO/AUDIO QUALITY, SUBTITLES AND AVAILABILITY OF ANY STREAM OR STREAM SOURCE.

CINEMABOX DISCOURAGES ANYONE FROM BREAKING OR VIOLATING ANY COPYRIGHT LAWS IN ANY WAY. OUR ANDROID TV BOXES ARE SOLD AS MINIATURE COMPUTERS THAT CONNECT TO YOUR TV. ANY OTHER USE OF THESE UNITS IS LEFT SOLELY TO THE END USER. ANY CUSTOMER USING ANY OF OUR PRODUCTS AGREES THAT CINEMABOX IS IN NO WAY LIABLE FOR ANY ACTIONS THEY PERFORM ON ANY OF THEIR PRODUCTS. OUR PRODUCTS ARE ANDROID OPERATED MINIATURE PERSONAL COMPUTERS. ANY OTHER USE OF THESE DEVICES IS SOLELY THE RESPONSIBILITY OF THE END USER. CINEMABOX TAKES NO RESPONSIBILITY FOR ANY ACTIONS THAT AN END USER MAY TAKE OR ENGAGE IN
